These Terms and Conditions of Use (the "Terms of Use") apply to the Farasha website

located at www.farasha.ae and all associated sites linked to www.farasha.ae by

Farasha, its subsidiaries and affiliates, including Farasha sites around the world

(collectively, the "Site").

The Site is the property of MAMA FARASHA – Sole Establishment ("Farasha") and its

licensors. BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT

AGREE, DO NOT USE THE SITE.

Farasha reserves the right, at its sole discretion, to change, modify, add or remove

portions of these Terms of Use, at any time. It is your responsibility to check these Terms

of Use periodically for changes. Your continued use of the Site following the posting of

changes will mean that you accept and agree to the changes. As long as you comply

with these Terms of Use, Farasha grants you a personal, non-exclusive, non

transferable, limited privilege to enter and use the Site.

Farasha may disable your user ID and password in Farasha’s sole discretion without

contractors as well as Farasha.

If any provision of this website disclaimer is, or is found to be, unenforceable under

applicable law, that will not affect the enforceability of the other provisions of this

INDEMNITY

You hereby indemnify Farasha and undertake to keep Farasha indemnified against any

losses, damages, costs, liabilities and expenses (including without limitation legal

expenses and any amounts paid by Farasha to a third party in settlement of a claim or

dispute on the advice of Farasha’s legal advisers) incurred or suffered by Farasha arising out of any breach by you of any provision of these terms and conditions, or arising out of

BREACHES OF TERM & CONDITIONS

Without prejudice to Farasha’s other rights under these terms and conditions, if you

breach these terms and conditions in any way, Farasha may take such action as

Farasha deems appropriate to deal with the breach, including suspending your access

to the website, prohibiting you from accessing the website, blocking computers using

your IP address from accessing the website, contacting your internet service provider to

request that they block your access to the website and/or bringing court proceedings

against you.

VARIATION

Farasha may revise these terms and conditions from time-to-time. Revised terms and

conditions will apply to the use of this website from the date of the publication of the

revised terms and conditions on this website. Please check this page regularly to ensure

you are familiar with the current version.

ASSIGNMENT

Farasha may transfer, sub-contract or otherwise deal with Farasha’s rights and/or

obligations under these terms and conditions without notifying you or obtaining your

consent.

You may not transfer, sub-contract or otherwise deal with your rights and/or obligations

under these terms and conditions.

SEVERABILITY

If a provision of these terms and conditions is determined by any court or other

competent authority to be unlawful and/or unenforceable, the other provisions will

continue in effect. If any unlawful and/or unenforceable provision would be lawful or

enforceable if part of it were deleted, that part will be deemed to be deleted, and the

rest of the provision will continue in effect.

ONLINE ORDERS

ORDERING WITH FARASHA

By placing an order with Farasha, either in store, on the phone or via our website (further

referred to as “the website”) you are agreeing to the following terms and conditions.

CHANGES TO YOUR ONLINE ORDER

If you wish to change your order, please contact us immediately. Please note that

changes to your order like the delivery address or the card message must be made before your order is prepared for delivery. Note any such changes may cause delays to

your delivery and you will be responsible for any extra charges that may arise because

the change order. Any such changes must be notified in writing by Whatsapp or to

info@farasha.ae. Please note that, once your order is under process, cancelation of

your order is possible only in exceptional circumstances and is entirely at our

discretion.

ONLINE ORDERS

In addition, the following applies to Online Orders: The email that is sent on completion

of your order contains all the key information about your order. It is very important that

you check this to ensure no errors have been made.

AVAILABILITY OF PRODUCTS

If we have difficulties to fulfil your order we will contact you and discuss suitable

alternatives. We make no guarantees that your order will always be in stock.

PERSONAL INFORMATION

To ensure that we can communicate effectively with both customers and recipients, it is

very important that you provide us with accurate contact information. We will never

share your identity with the recipient, even if they request this information. Please note

that we value your privacy and will never disclose or sell your private information.

PROMOTIONAL CODES

From time to time we may offer promotional codes or products at discounted prices.

These offers are valid from the time that we introduce them to the end date of the offer

and they cannot be used for purchases before the offer introduction date or after the

offer end date. A special offer or promotional code cannot be used in conjunction with

any other special offer or promotional code. In the event that a customer has made a

purchase and the price of a product falls or is discounted due to a special offer or

promotional code, the price of the product at the time of purchase shall 'prevail'. We are

unable to offer special offer discounts or apply promotional codes for purchases that

have already been made. As our special offers are often made available due to the

availability of products, we may change the terms of special offers, or withdraw them

altogether, at any time and without prior notice. We also reserve the right to offer

personalized special offers and promotions which will only be redeemable by the

customer in receipt of the special offer.

COPYRIGHT AND TRADEMARKS Farasha™ is a Registered Trademark. The use of logo, mark or any part of it is prohibited

unless authorized by Farasha.

PAYMENT TERMS AND CONDITIONS

We accept Visa and MasterCard in AED and USD for payments of good and services

on www.farasha.ae. Your credit card or debit card statements will reflect Farasha. In

case of third party statements including bank and credit card statements the merchant

name may appear in an abbreviated format.

To place an order you will need to complete the transaction on the website

www.farasha.ae. After you have made your selection and added products to your

shopping cart, you will need to proceed to the checkout section. In this section you will

be asked for delivery and billing address, and other contact information as well as

payment related information. Once the payment transaction has been successfully

completed, your order will only be processed on receipt of the funds from the bank or

Credit Card Company. It is at this stage that the sale is said to be complete. Thereafter

your products will be shipped based on product availability and completion of logistics

operations related to the same.

A full list of payment options, including credit and debit cards is available at the time of

Check Out and prior to making payments for purchases.

As prescribed by the financial institutions issuing the credit or debit cards affiliated with

Visa and Mastercard you will be required to submit your payment information when you

make your online transaction using your Credit or Debit card. You may also have to have

enrolled your Credit Card with VBV (Verified by Visa) or MSC (Mastercard Secure Code)

to complete the transaction.

Farasha does not trade with or provide any services to OFAC and sanctioned countries.

Customers using the website who are minor / under the age of 18 shall not register as a

user of the website and shall not transact on or use the web site.

Cardholder must retain a copy of any transaction records and merchant policies and

rules. User is responsible for maintaining the confidentiality of his/her account.

SECURITY

All transactions on our website are securely processed through Stripe, a globally trusted

and PCI-DSS-compliant payment gateway. Your payment details are encrypted using

industry-leading security protocols, including SSL (Secure Sockets Layer) encryption

and TLS (Transport Layer Security) to ensure your information is transmitted safely and

securely.We do not store or have access to your full credit card details. All payments are

processed in real time with strong encryption and fraud prevention measures in place,

giving you complete peace of mind with every purchase.

Credit card and Debit card information is not stored by us and is not taken by us. This

information is taken directly by the payment gateway provided who is authorised and is

compliant with the regulations and requirements of various banks and institutions and

payment franchisees that it is associated with.

PRODUCT PRICING

Product prices listed on the website are current. While every care has been taken to

label the products accurately, errors in data entry may occur. We reserve the right to

cancel the order in case a transaction has been made where the price indicated was not

the correct price. In the rare event that happens, we will give a full refund of all money

received from the customer.

Prices are subject to change without advance notice.

All prices on this website are in AED. For international cards used on the site, the banks

applicable exchange rate and charges will apply. We have no jurisdiction on this and any

disputes or queries on exchange rates and bank charges need to be directed to the bank

or institution that issued your card or payment instrument

All orders are acknowledged at current pricing. We will bill at price in effect at the time

of receipt of money and raising of an invoice.

The displayed price and currency at the checkout page, will be the same price and

currency printed on the Transaction Receipt and the amount charged to the card will be

shown in your card currency.

DESTINATION CHARGES

All product prices, including shipment charges and insurance, are exclusive of any

applicable destination charges such as, but not limited to, Customs Duties and Import

taxes and clearance charges.

OUT OF STOCK SITUATIONS

We strive to ensure that all products listed on our website are available and ready for

timely dispatch. However, as we work with live products, there may occasionally be

unforeseen circumstances that affect availability. While we make every effort to fulfill all

orders, we cannot guarantee availability at all times.

Should an item become unavailable, we will notify you as soon as possible—at least

one day prior to your scheduled delivery. At that point, you will be offered the option to exchange the product, reschedule the delivery, or cancel the order entirely, based on

your preference.

DELIVERY OF PRODUCTS

We currently deliver our products exclusively within the United Arab Emirates. All orders

are shipped from the UAE, either by our in-house team or through a trusted third-party

courier service.

Delivery to UAE cities typically occurs within 2–3 business days, and shipping

availability will be clearly indicated at checkout, depending on the selected Emirate. To

help avoid any delays, please ensure that you provide a complete and accurate delivery

address, along with up-to-date contact information.

Deliveries must be scheduled by you, the customer, in accordance with the available

options shown at the time of placing your order. It is your responsibility to ensure that

someone is available at the delivery location during the agreed time frame to accept the

order.

Given the delicate and live nature of our products, it is essential that they are received

immediately upon delivery and handled with care. Please follow all handling and

storage instructions as outlined on our website or provided at the time of purchase.

Failure to do so may result in product damage or the death of the live butterflies, for

which Farasha cannot be held liable.

A signature is required upon delivery. We are not responsible for goods signed for by any

individual other than the intended recipient at the shipping address provided.

Please note:

• Farasha is not liable for delays or failed deliveries due to incorrect or incomplete

addresses supplied during checkout.

• We do not accept responsibility for any damage occurring after delivery has been

completed.

Any claims for shortages or damages must be reported to our customer service team on

the day of delivery via WhatsApp or email at info@farasha.ae. Additionally, any

discrepancies must be noted on the Proof of Delivery document and signed before

being returned to the delivery personnel.

DELIVERY CHARGES

Shipping and handling rates may vary based on product, packaging, size, volume, type

and other considerations. The shipping and handling charges are given at the time of

check out and consumers will know about this before making payments.

PRODUCT RETURNS AND EXCHANGESOnce products are delivered to you and accepted as accurate and as per the original

order, there is no refund possible.

To return any items that are damaged or not as per your original order, please send an

email within 1 hour of the receipt of the product including images of the damaged items

to info@farasha.ae, together with your order number. One of our customer service

representatives will handle your claim directly and apply the appropriate remedy to

resolve the matter in the quickest possible timeframe. Refunds are not guaranteed and

at the entire discretion of Farasha.

Please note that we cannot offer exchanges on any sale, any opened or used products.

Customers can cancel their orders within 24 hours of receiving the order confirmation

email and as long as the product has not been shipped to the customer. Refunds will be

made back to the payment solution used initially by the customer. Please allow for up

to 45 days for the refund transfer to be completed.

DISPUTES

Any purchase, dispute or claim arising out of or in connection with this web site shall be

governed and construed in accordance with the laws of the United Arab Emirates.

ENTIRE AGREEMENT

These terms and conditions constitute the entire agreement between you and Farasha

in relation to your use of this website and supersede all previous agreements in respect

of your use of this website.

LAW & JURISDICTION

United Arab Emirates is our country of domicile. These terms and conditions will be

governed by and construed in accordance with laws of the United Arab Emirates and

any disputes relating to these terms and conditions will be subject to the exclusive

jurisdiction of the courts of the United Arab Emirates.
